Services for defaulting sponsors and sponsored persons

The sponsor signs an agreement with the Québec government undertaking to provide for the basic needs of the foreign national he or she is sponsoring and, if necessary, reimburse the Ministère de l'Emploi et de la Solidarité sociale for any last-resort financial assistance benefits that might be paid to that person.

The Centre spécialisé des demandeurs d'asile, des garants défaillants et des services aux parrainés works in collaboration with the Ministère de l'Immigration et des Communautés culturelles to ensure application of and compliance with the sponsorship agreement. This involves an integrated approach combining individualized support and guidance and the accountability of individuals with regard to their obligations under the sponsorship agreement. This approach, applied throughout Québec, primarily involves:

• initial granting of benefits and management of active files of sponsored persons ;
• support to help sponsors resume responsibility for sponsored persons;
• billing of defaulting sponsors ;
• participation in the Comité d’étude sur la violence ou le risque de récidive (review committee on violence and the risk of reoffending) to determine, based on the information gathered, whether a situation constitutes a genuine and serious case of violence for a defaulting sponsor or sponsored person.

The Centre spécialisé’s mission is to promote the socioeconomic integration of sponsored recipients. To that end, it proposes solutions to help them achieve financial independence. Emploi-Québec, the Ministère de l’Immigration et des Communautés culturelles and non-governmental bodies participate in this initiative by providing employment services.

The Centre spécialisé studies and processes last-resort financial assistance applications and oversees the management of active files of sponsored recipients.

Where a sponsored person applies for last-resort financial assistance, the Centre spécialisé will first see if the sponsor can resume responsibility for the sponsored person by, for example, providing the person with room and board (in the sponsor’s or someone else’s home), supporting the person financially or placing the person under the responsibility of a third party.

If the sponsor is unable to resume responsibility for the sponsored person, the latter will be granted last-resort financial assistance. However, the sponsor will receive a notice of claim for reimbursement of the sums granted.
