Contesting an initial decision

Before submitting a review application

First, ask the officer in charge of your file for an explanation. Feel free to contact the person who handed down the decision for further information to help you understand the reasons for the decision. This will also be an opportunity to provide any additional explanations or documents.

Make sure the decision you are contesting is eligible for review.

What decisions are eligible for review?

Decisions by the office in charge of your file, including claim notices, decisions concerning applications under the social solidarity and social assistance programs, including limited capacity for employment allowances and monthly cheques can generally be reviewed. However, there are certain exceptions that the officer in charge of your file can explain to you.

Since January 1, 2006, decisions concerning notices of claim issued for benefits allocated through measures and programs established under the Act respecting the Ministère de l'Emploi et de la Solidarité sociale and establishing the Commission des partenaires du marché du travail, such as the Pregnant Minors Financial Assistance Measure, the income support programs for workers affected by collective dismissals, and the Financial Support Program for Older Workers Who Have Lost Their Jobs in the Forest Industry have also been eligible for review. Other decisions to enforce these measures and programs are not eligible for review, but can be subject to an administrative review. Contact the person in charge of your file for more information.

Lastly, all decisions handed down under the Québec Parental Insurance Plan are eligible for review. However, if you wish to contest the amount of your contribution, please contact Revenu Québec.

Applications for review do not suspend the enforcement of contested decisions. For example, in the case of assistance provided under the social assistance and social solidarity programs, if the decision of the office in charge of your file reduces the amount of your monthly cheque, you will receive the reduced amount until a new decision is handed down.
